This Privacy Policy is issued by GKS Law Pty Ltd trading as GKS Law, and (where applicable) The trustee for GKS Trust (ABN 19 425 218 509)(together, “GKS Law”, “we”, “us” or “our”).

We also operate a North Brisbane office at 1341 Gympie Road, Aspley QLD 4034. Personal information collected at any office, by phone, by email or through this website is managed from our Redcliffe head office unless we tell you otherwise.

We are a Queensland law practice providing legal services in personal injury, wills and estates, commercial and property law, and conveyancing, primarily to clients in Redcliffe, the Moreton Bay region and North Brisbane.

We manage personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act), the Australian Privacy Principles (APPs), the Notifiable Data Breaches scheme, and our professional obligations of client confidentiality under the Legal Profession Act 2007 (Qld) and the Australian Solicitors’ Conduct Rules.

Solicitor–client confidentiality and legal professional privilege apply in addition to this Policy.

2. Scope of this Policy

This Policy explains how we collect, hold, use, disclose and otherwise handle personal information about:

  • clients and prospective clients
  • other parties to a matter (for example opposing parties, witnesses, executors, beneficiaries, purchasers and vendors)
  • referees, next of kin and emergency contacts
  • visitors to this website and people who complete our online forms (including the Free Claim Check)
  • suppliers, referrers, barristers, experts and other professional contacts
  • job applicants and staff

This Policy applies to personal information collected at our Redcliffe head office, at our Aspley office, in person, by phone, email, post, through our website and online forms, through e-conveyancing platforms, and from third parties.

3. The kinds of personal information we collect and hold

The information we collect depends on why you contact us. We only collect what is reasonably necessary for our functions and activities.

3.1 Ordinary personal information

This may include:

  • name, date of birth, gender and contact details (address, email, phone)
  • identification details (for example driver’s licence, passport or Medicare number, where needed to identify you or meet legal obligations)
  • occupation, employer and employment history
  • financial information, including bank details for trust accounting, invoices and settlements
  • property details, title particulars, mortgage and loan information
  • details of your legal matter, instructions and correspondence
  • information about other people connected with your matter
  • website and device information (IP address, browser type, pages viewed, date and time of visit)

3.2 Sensitive information

We only collect sensitive information where it is reasonably necessary for our services and either you consent, or an exception in the Privacy Act applies (for example the information is required or authorised by law, or is necessary to establish, exercise or defend a legal or equitable claim).

Sensitive information we may collect includes:

  • health and medical information (especially for personal injury, workers compensation, motor vehicle and public liability matters, and for powers of attorney / advance health directives)
  • racial or ethnic origin, where relevant to a claim or identity check
  • religious beliefs, where relevant to a will or funeral direction
  • sexual orientation or relationship status, where relevant to a family, estate or injury matter
  • membership of a professional or trade association or trade union
  • criminal record information, where relevant to a matter
  • biometric information used for identity verification, if we use an identity-verification service

3.3 Information about children

We may collect information about children where it is necessary for a matter (for example a will, estate, family arrangement, or a claim involving a minor). We collect that information from a parent, guardian or other authorised person wherever practicable.

4. How we collect personal information

4.1 Directly from you

We usually collect personal information directly from you when you:

  • attend or telephone our Redcliffe head office or our Aspley office
  • enquire by email or post to the Redcliffe head office
  • complete our Free Claim Check or other website forms
  • engage us and complete a client agreement, identification check or questionnaire
  • attend a conference or send us documents
  • pay an invoice or provide trust account details
  • apply for a job or otherwise deal with us as a supplier or referrer

4.2 From other people and organisations

We may also collect personal information from:

  • family members, attorneys, executors, guardians or other representatives
  • other lawyers, barristers, courts, tribunals and government agencies
  • insurers, superannuation funds, employers and WorkCover / CTP insurers
  • treating doctors, hospitals, allied health providers and medico-legal experts
  • real estate agents, brokers, valuers, surveyors and financiers
  • PEXA and other electronic conveyancing or settlement platforms
  • Titles Queensland, the Queensland Revenue Office, ASIC, the ATO and similar registries
  • publicly available sources (for example court lists, property registers and company searches)
  • referrers and existing clients

If we collect personal information about you from someone else, we will take reasonable steps to notify you, unless it is unreasonable or impracticable to do so.

4.3 Automatically via our website

When you visit our website, we and our service providers may collect technical information such as your IP address, device and browser type, referring pages and pages viewed. See section 11.

5. Why we collect, hold, use and disclose personal information

We collect, hold, use and disclose personal information for purposes that are reasonably necessary for our functions and activities at our Redcliffe head office and in the course of our practice, including:

  • assessing enquiries and providing a Free Claim Check or initial consultation
  • deciding whether we can act, managing conflicts, and opening a file
  • providing legal advice and legal services
  • corresponding with you and others involved in your matter
  • conducting litigation, negotiations, settlements and alternative dispute resolution
  • preparing wills, enduring documents, estate administrations and probate applications
  • acting on property purchases, sales, leases and related commercial transactions
  • completing electronic conveyancing and settlement through PEXA or similar platforms
  • verifying identity and meeting anti-money laundering, counter-terrorism financing, sanctions and trust-accounting obligations
  • issuing invoices, operating our trust and office accounts, and recovering fees
  • managing our practice, quality, insurance, risk and professional regulation from our Redcliffe head office
  • dealing with complaints and regulatory enquiries (including the Queensland Law Society and the Legal Services Commission)
  • considering job applications and managing staff
  • improving our website and services
  • sending information about our services where permitted (see section 8)
  • complying with the law

If you do not provide the information we reasonably need, we may be unable to act for you, complete a transaction, or respond to your enquiry.

We will not use or disclose personal information for a purpose other than the purpose of collection unless you have consented, you would reasonably expect the related use or disclosure, Australian law or a court/tribunal order requires or authorises it, or another APP exception applies.

6. Who we disclose personal information to

We do not sell personal information.

We may disclose personal information to:

  • our directors, employed solicitors, paralegals and administrative staff at our Redcliffe head office and Aspley office, on a need-to-know basis
  • barristers, expert witnesses, medical practitioners and other consultants we engage on a matter
  • other parties to a matter and their lawyers, where that is part of acting for you
  • courts, tribunals, registries and government agencies
  • insurers (including professional indemnity insurers) and brokers
  • banks, settlement agents and PEXA (or another ELNO) for conveyancing and trust transactions
  • our IT, cloud hosting, email, document-management, accounting and practice-management providers
  • our professional advisers (for example accountants and auditors)
  • a purchaser or successor of our practice, if the practice is transferred
  • anyone you authorise, or to whom we are required or authorised by law to disclose information

Where we use contractors, we take reasonable steps to ensure they handle personal information in a manner consistent with the APPs.

7. Overseas disclosure

Some of our service providers (for example email, cloud storage, website hosting, video-conferencing or e-conveyancing platforms) may store or access information on servers outside Australia.

Those locations may include the United States, the European Union, the United Kingdom, Singapore and New Zealand. The countries used can change as our providers change their infrastructure.

If we disclose personal information to an overseas recipient, we will take reasonable steps to ensure the recipient does not breach the APPs in relation to that information, unless an exception in APP 8 applies (for example you consent, or the disclosure is required or authorised by Australian law).

Overseas recipients may not be subject to Australian privacy law, and you may not be able to seek redress under the Privacy Act for their acts.

8. Direct marketing

We may use your contact details to send you information about our Redcliffe and North Brisbane services, seminars or firm news where you would reasonably expect that, or where you have consented.

You can opt out at any time by using the unsubscribe link in an email or by contacting the Redcliffe head office at [email protected]. We will process opt-out requests promptly.

We do not sell your contact details to third parties for their marketing.

9. How we hold and protect personal information

Personal information is held at our Redcliffe head office in paper files and in electronic systems used by the practice (including practice-management, email, document-management and cloud systems). Files opened at Aspley form part of the same practice records administered from Redcliffe.

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Those steps include:

  • restricted physical access to our Redcliffe head office, Aspley office and file storage
  • staff access on a need-to-know basis
  • passwords, multi-factor authentication where available, and access controls
  • secure destruction or de-identification of information when it is no longer needed
  • contractual and practical controls on service providers

No method of storage or transmission is completely secure. If you email us unencrypted, there is a risk the message could be intercepted.

9.1 How long we keep information

We keep client files for at least the period required by professional conduct rules and our insurers — generally seven years after a matter ends, and longer where the matter involves a minor, a will, an estate, or a reason to retain the file (for example an ongoing risk of a claim).

We then destroy or de-identify the information in a secure way at our Redcliffe head office, unless we are required or authorised to keep it.

10. Data breaches

If we have reasonable grounds to believe that an eligible data breach has occurred under the Notifiable Data Breaches scheme, our Redcliffe head office will assess the breach and, where required, notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable.

If you think your information with us may have been compromised, contact our Privacy Officer at the Redcliffe head office immediately.

11. Cookies and the website

Our website may use cookies and similar technologies.

  • Essential cookies help the site function (for example page load and security).
  • Analytics cookies(if enabled) help us understand how the site is used. These may be set by providers such as Google.
  • Embedded content(for example maps or video) may set third-party cookies.

You can control cookies through your browser. Blocking some cookies may affect how the site works.

Our website may contain links to other sites. We are not responsible for the privacy practices of those sites.

12. Automated decisions

We do not currently arrange for a computer program to use personal information to make, or to do something substantially and directly related to making, a decision that could reasonably be expected to significantly affect an individual’s rights or interests.

Decisions about whether we act, how a matter is conducted, and the advice we give are made by our solicitors, including from our Redcliffe head office.

If that changes, we will update this Policy before those arrangements take effect, including (from 10 December 2026) the kinds of personal information used, the kinds of decisions involved, and how human review works, as required by APP 1.7–1.9.

13. Anonymity and pseudonymity

Where it is lawful and practicable, you may deal with us without identifying yourself (APP 2). In most legal matters this is not practicable, because we must identify our client, manage conflicts, operate a trust account, and meet court, conveyancing and anti-money laundering requirements.

14. Access to your personal information

You may request access to the personal information we hold about you.

We will respond within a reasonable time, generally 30 days.

We may refuse access where the Privacy Act allows, including where:

  • giving access would pose a serious threat to life, health or safety
  • giving access would have an unreasonable impact on someone else’s privacy
  • the information is legally privileged or giving access would prejudice legal proceedings
  • giving access would be unlawful, or we are required or authorised by law to refuse

If we refuse, we will give you written reasons and information about how to complain, unless it is unreasonable to do so. We may charge a reasonable fee for giving access (for example photocopying or file retrieval from our Redcliffe records), but not for making the request.

15. Correction of personal information

If you think personal information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, ask us to correct it using the Redcliffe head office contact details in section 14.

We will take reasonable steps to correct the information within a reasonable time, generally 30 days. If we refuse, we will explain why and how you can complain. You may also ask us to associate a statement with the information.

16. Complaints

If you believe we have breached the APPs or mishandled your personal information:

  2. We will acknowledge your complaint and investigate from our Redcliffe head office. We aim to respond within 30 days.

17. Staff and job applicants

If you apply for a role with us, applications are received and assessed at our Redcliffe head office. We collect the information on your application and any information you or your referees provide. We use it to assess your application and, if you are employed, to administer your employment. Unsuccessful applications are generally kept only for a limited period then securely destroyed, unless you ask us to keep your details for future roles.

18. Changes to this Policy

We may update this Policy from time to time to reflect changes in the law, technology or our practice. The current version will be published on this website. The “Last updated” date at the top shows when it was last revised.

Retention

We do not combine the information collected through the use of Google Analytics with personally identifiable information. Third party collection of information

Our policy only addresses the use and disclosure of information we collect from you. Out of respect to your right to privacy we provide you within such marketing materials with means to decline receiving further marketing offers from us. If you unsubscribe we will remove your email address or telephone number from our marketing distribution lists.
